WARRANTY POLICY

As your assurance of the quality of its Products, Automotive Performance Systems, Inc. ("APS"), offers the following limited warranty, applicable in the U.S.A. and Canada only:

Limited Warranty. APS warrants to the original retail purchaser who retains ownership of the vehicle on which the Product was originally installed (the “Consumer”) all of its Neuspeed products for one (1) year against manufacturing and/or material defects from date of purchase, unless stated otherwise on individual product listing on this website. 

Exclusions from Warranty. This warranty shall not apply to any Product that was not properly installed by a qualified, licensed auto mechanic experienced in the installation of the Product purchased, any Product that was improperly serviced, or any Product that was misused or damaged (if such damage did not result from a Product defect or malfunction). This warranty shall not apply unless the Consumer promptly discontinues use of the Product upon discovery of the defect or premature wearing.

THIS WARRANTY DOES NOT APPLY TO ANY PRODUCT THAT HAS BEEN: (1) MODIFIED, ALTERED OR SUBJECTED TO ABUSE, NEGLIGENCE, ACCIDENT OR COLLISION; (2) IMPROPERLY INSTALLED ON ANY VEHICLE FOR WHICH IT WAS NOT DESIGNED; (3) INSTALLED ON ANY VEHICLE THAT HAS BEEN MODIFIED; (4) INSTALLED ON ANY VEHICLE THAT HAS CARRIED LOADS IN EXCESS OF THE AUTOMOBILE MANUFACTURER’S SUGGESTED WEIGHT LIMITS; (5) INSTALLED ON ANY VEHICLE THAT HAS BEEN USED FOR RALLYING, RACING, RACING-TYPE ACTIVITIES OR OFF-ROAD USE; OR (5) PRESENTED FOR WARRANTY COVERAGE AFTER BEING USED ON A VEHICLE OTHER THAN THE VEHICLE ON WHICH IT WAS ORIGINALLY INSTALLED.

THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED (INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE), THAT EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF. ANY IMPLIED WARRANTIES ARE DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

IN NO EVENT SHALL APS, ITS DIVISIONS, EMPLOYEES, AND AFFILIATES BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL OR INCIDENTAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, LOSS OF USE OF VEHICLE, REVENUE, SALES, OR COSTS OF PROCUREMENT OF SUBSTITUTE GOODS, PROPERTY DAMAGE, INCLUDING WITHOUT LIMITATION DAMAGE TO VEHICLE OR COMPONENT PARTS, PERSONAL INJURY, INTERRUPTION OF BUSINESS, OR FOR ANY DIRECT, INDIRECT, INCIDENTAL, ECONOMIC, COVER, AND PUNITIVE DAMAGES, RESULTING FROM POSSESSION, USE OR MALFUNCTION OF THE PRODUCT, EVEN IF APS HAS BEEN ADVISED OF THE POSSIBILITY OF THOSE DAMAGES. SOME STATES DO NOT PERMIT THE EXCLUSION OF CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. TO THE EXTENT THAT A STATE DOES NOT ALLOW AN EXCLUSION OF LIABILITY BUT ALLOWS A LIABILITY TO BE LIMITED, THE LIABILITY OF APS, ITS DIVISIONS, EMPLOYEES AND AFFILIATES SHALL BE LIMITED TO THE PURCHASE PRICE OF THE PRODUCT.

THIS WARRANTY GIVES THE CONSUMER SPECIFIC LEGAL RIGHTS. THE CONSUMER MAY HAVE ADDITIONAL RIGHTS THAT MAY VARY FROM STATE TO STATE.

This warranty information and the specific warranty information included with the Product constitutes the entire agreement between APS and Consumer and exclusively determines the rights and obligations of the parties, any prior course of dealing, custom or usage of trade, or course of performance notwithstanding, and supercedes all prior agreements and understandings, whether oral or written.
 


 

Automotive Performance Systems, Inc. - Warranty Claim Procedure

To submit a warranty claim, the Consumer should contact Automotive Performance Systems, Inc. ("APS), directly for verification of warranty coverage. All warranty returns must conform to the following procedures:

  1. All Products should be wrapped or packed in a shipping box to prevent damage during shipping.
  2. All returns must have a Return Goods Authorization (RGA) tracking number Issued by an APS customer service representative.
  3. All returns must be shipped FREIGHT PREPAID, return receipt requested. Call tags and collect shipments are not permitted.
  4. A copy of the original invoice, a statement containing the Consumer's name and address, a brief description of the defect, and a complete description of the make, model, year of the vehicle must accompany all Products.

Removal and re-installation of the Product is the sole responsibility of the Consumer. Within 10 business days after receipt by APS of the defective or prematurely worn Product and the submission of all the information above, APS will replace or repair, at its option, such Product.

Service Rights. The Consumer of an APS Product in California has a right to have the Product serviced or repaired during the warranty period. The warranty period will be extended for the number of whole days that the Product has been out of the Consumer's hands for warranty repairs. If a defect exists within the warranty period, the warranty will not expire until the defect has been fixed. The warranty period will also be extended if the warranty repairs have not been performed due to delays caused by circumstances beyond the control of the Consumer, if the warranty repairs did not remedy the defect and the Consumer notifies APS or the dealer of the failure of the repairs within 60 days after they were completed. If, after a reasonable number of attempts, the defect has not been fixed, the Consumer may return the Product for a replacement or a refund subject, in either case, to deduction of a reasonable charge for usage. This time extension does not affect the protections or remedies the Consumer has under other laws.

 


 

Standard Return Policy:

Purchased items are returnable within 15 days of receipt. Claims for missing items or items damaged in transit must be received within two business days of receipt of merchandise.

You have the option of exchanging the item(s) or receiving a refund for the amount of the original purchase price minus shipping cost and (if applicable) restocking fee. Refunds on returned items will be issued in the same payment form as tendered at the time of purchase. If payment was made by credit card, once we receive the product we will credit your account. Please allow 7-10 days for a credit to appear on your credit card statement. If payment was made by check, the refund check will be issued after 10 business days from the date of purchase.

Please read all conditions below. APS reserves the right to refuse the return or to charge a restocking fee of 20%.

  • All returned or exchanged items must be in new condition, in their original box, and must include all packing material, manuals, and all accessories.
  • All returns must be accompanied by original receipts.
  • Return Goods Authorization (RGA) request must be made prior shipping items back to APS.
  • Defective items may be repaired or exchanged at our discretion for the same model or manufacturer's equivalent model.
  • RMA numbers are valid for 10 days.
  • APS is not responsible for any consequential or incidental damage resulting from the sale or use of any merchandise bought from us. We are responsible for the monetary value of the merchandise only.

No Return/Exchange On:

  • Tire mounted wheels. NO EXCEPTION!
  • Installed items
  • Items purchased from our dealers and not APS directly
  • Special order item
